This English version is a translation provided for convenience. In any conflict, the Hebrew version of these Terms shall prevail.
1. General and status of the agreement
Welcome to heskemim.co.il (the “Site”), operated by Ofer Rosenbloom, Adv. (the “Operator”).
These terms of use (the “Terms”) constitute a binding legal agreement for all intents and purposes between the user of the Site (the “User”) and the Operator, in accordance with the Contracts Law (General Part), 5733-1973.
Browsing, viewing or using the Site constitutes full and unreserved acceptance of these Terms and of the Privacy Policy. A User who does not agree to the Terms, in whole or in part, must refrain from any use of the Site.
2. Nature of the information — no legal advice
The content on the Site, including articles, explanations and information on mediation and arbitration, is provided as general information for informational purposes only. Nothing on the Site constitutes legal advice, a professional opinion, a recommendation or a substitute for individual advice that takes the specific circumstances into account. Reliance on the Site’s content as legal advice is prohibited, and any such reliance is at the User’s sole responsibility.
3. No attorney-client relationship
It is clarified unequivocally that browsing the Site, reading the articles, or sending an enquiry through the Site’s contact form or by email does not and shall not create an attorney-client relationship or a mediator/arbitrator-client relationship between the User and Ofer Rosenbloom, Adv. Such a relationship shall be created only after the mutual and explicit signing of a written fee agreement or an agreement to commence proceedings.
4. Disclaimer of liability
The content and services on the Site are provided on an “As-Is” and “As-Available” basis.
Use of the Site and its content is at the User’s sole and full responsibility (As-Is and As-Available), and the Operator shall bear no liability for any direct, indirect, consequential or special damage caused to the User or to any third party.
The Operator does not warrant that the Site will operate continuously, without interruptions, faults or errors, and is not responsible for the availability, integrity or content of external sites and services.
5. Intellectual property
All intellectual property rights in the Site — including the article content, texts, structure, design, source code and graphic elements — are reserved to the Operator and are protected under the Copyright Law, 5768-2007, and under any law.
Copying, reproduction, distribution, publication, automated scraping or any commercial use of the Site’s content, in whole or in part, is strictly prohibited without the Operator’s prior written consent.
Using the Site’s content, or collecting or processing it, for the purpose of training, developing or feeding artificial-intelligence (AI) models is strictly prohibited without the Operator’s prior written consent.
6. Prohibited use
The User undertakes not to make any unlawful or unauthorized use of the Site, not to harm its proper operation or security, and not to attempt to gain unauthorized access to its systems or to the information stored in it.
7. Links to external sites
The Site may contain links to third-party websites. The Operator has no control over such content and is not responsible for it or for any damage arising from its use.
8. Changes to the Terms and the Site
The Operator may update the Terms, as well as the Site and its content, from time to time at its sole discretion. The updated version will be published on this page and will bind the User from the time of its publication.
9. Governing law and exclusive jurisdiction
These Terms and any matter arising from or related to them shall be governed solely by the laws of the State of Israel.
Exclusive and sole jurisdiction over any dispute or matter relating to the Site and to these Terms is vested solely in the competent courts of the Central District, thereby expressly negating the jurisdiction of any other court.
